1. PLATFORM ROLE & LIMITATIONS

Point EV (the "Platform") provides a digital search and information portal for Electric Vehicles (EVs).

No Dealer Status

Point EV is not a motor vehicle dealer, broker, or agent. We do not own, sell, or inspect any vehicles listed.

Transaction Disclaimer

All negotiations and sales are strictly between the User and the Listing Dealer. Point EV is not a party to any contract or transaction resulting from the use of this Platform.

2. EV DATA & BATTERY DISCLOSURE

Vehicle data is provided via third-party inventory feeds (e.g., vAuto, Solera).

Technical Specs

All EV-specific metrics—including Battery State of Health (SOH), Range (EPA or Real-World), and Charging Standards—are provided for informational purposes only.

Accuracy

We do not verify the physical condition or battery health of any vehicle. Buyers must perform independent inspections. We are not liable for "range anxiety," battery degradation, or hardware/software compatibility issues.

Availability

Due to technical sync latencies, vehicles shown as "Available" may have been sold. The Dealer’s physical inventory takes precedence over Platform listings.

3. DEALER SUBSCRIPTION TERMS

Service Fee: Access to the Platform for Dealers is provided on a subscription basis calculated on the Billing page based on the number of dealerships in your inventory feed.

Feed Authorization

By providing FTP or API credentials, Dealers represent they have the legal right to distribute said data and grant Point EV a license to display and enrich this data.

Cancellation

Subscriptions are month-to-month. Termination is effective at the end of the current billing cycle. No pro-rated refunds are issued.

4. INTELLECTUAL PROPERTY & PROHIBITED USE

Ownership: The Platform’s layout, proprietary "EV Enrichment" data mapping, and branding are the property of Point EV.

No Scraping

Automated extraction of data (scraping) from this Platform for commercial use is strictly prohibited.

Lead Integrity

Users agree not to submit fraudulent inquiries or "spam" via Dealer contact forms.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Point EV and its officers shall not be liable for:

• Any mechanical, battery, or software defects in a vehicle discovered after purchase.
• Inaccuracies in pricing, mileage, or features provided by Dealer feeds.
• Loss of profits or "lost deals" due to Platform downtime or sync errors.

Cap on Damages

In no event shall our total liability exceed the total amount paid by you to Point EV in the preceding 1 month.

6. INDEMNIFICATION

Users and Dealers agree to indemnify and hold Point EV harmless from any claims, damages, or legal fees arising from (a) a breach of these Terms, (b) the sale of a vehicle listed on the Platform, or (c) the inaccuracy of any Dealer-provided data.
